RE: The tariff classification of a Road Marking Re-Striping System from Belarus

Dear Mr. Riley:

In your letter dated May 20, 2014, on behalf of your client Potters Industries, LLC, you requested a tariff classification ruling.

The imported item is a road marking re-striping system “LIS” which is designed for automatic renewal of old road markings. This system contains 3 different modes, i.e., a) automatic mode, b) “repeat of marking” mode and c) manual mode. The LIS is designed for re-striping of center and edge road marking lines in a continuous motion mode with any sequence of mentioned lines. The unit does not respond to previous road markings or other white stains of a length of less than 50cm. It does discontinue the marking on intervals of a length of less than 30 cm where the previous marking is deteriorated or absent. The unit is able to be operated at night or during the day. The unit is equipped with three video cameras and the camera signals are transferred onto 2 LCD monitors. The operator controls the first monitor with the help of a camera to control the trailer and the marking (painting) guns. There is also a camera installed in the rear that allows for controlling the trailer during transportation. The second monitor allows for seeing the part of the road of a length of more than 4 meters ahead of the marking module. The trailer weighs 750 kg and contains 2 pairs of painting guns.

The applicable subheading for the Road Marking Re-Striping System “LIS” will be 8479.10.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Machines and mechanical appliances having individual functions, not specified or included elsewhere in this chapter, parts thereof: Machinery for public works, building or the like … Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
